From the Toronto Star: For Toronto lawyer Michael Deverett, it was an expensive sale. Apple was advertising free iPods with the purchase of a MacBook pro computer. On Thursday, Sept. 3, 2009, Deverett drove to the Apple store at the Yorkdale Mall and bought a MacBook Pro, an iPod Touch, cables and programs for $2,248.53 including taxes.
He didn’t notice anyone following him that evening out of the mall to his car, where he piled the Apple packages deep inside the hatchback so no one could see them. He didn’t notice anyone following him on the drive home or pulling up near him when he stopped at a convenience store to buy a soft drink for his daughter.
In the two minutes it took Deverett to buy a drink, thieves smashed a hole in the rear window of his car and made off with his Apple purchases. Deverett didn’t notice until he got back in the car and began backing up – he turned around just in time to see what was left of his rear window collapsing into pieces.
Deverett sued Apple, claiming that theft rings in the U.S. had been targeting Apple store customers in the same way and Apple had a duty of care to warn store customers of the danger. Apple also serviced Deverett’s stolen computer for someone else even after Deverett called to tell them it was stolen….
